Can you still get a refund if you file Canadian taxes years late?
2026-10-31 · 6 min read · Tax Everyday, Vaughan
Usually, no, not if you wait past three years. CRA’s rule is that a refund is not paid when the return is filed more than three years after the end of the tax year. The tax year for individuals ends on 31 December. So a 2023 refund must be claimed by 31 December 2026. A 2022 refund had to be claimed by 31 December 2025, and that window is closed. A 2024 refund can be claimed until 31 December 2027. A 2025 refund can be claimed until 31 December 2028.
That limit is about the refund, not about whether you may ignore the year. If you owed tax, CRA can still assess the old year. If you are due a refund and you file inside the window, file it. The money is real until the date passes, and then it generally is not.
What people hope will override the rule
Taxpayer relief can cancel penalties and interest going back as far as 10 calendar years. It is a request, not a right, and it is aimed at interest and penalty. It is not a reliable way to force CRA to pay a refund that is outside the three-year rule. Do not build a catch-up plan on the hope that relief will recreate a 2019 refund.
- File 2023 now if you were an employee with tax withheld. That refund dies on 31 December 2026.
- File 2024 and 2025 on the same pass. Both refunds are alive.
- Still file 2021 and 2022 if they are part of a chain, a benefit, or a spouse’s return, even when the refund itself is late.
- A reassessment of a year that was filed on time is a different clock. This note is about a return that was never filed.
Do not trade a live refund for a perfect folder
If the only thing holding 2023 is a missing T4, get the slip from the employer or from CRA’s records and file. Perfect receipts for a small donation are not worth missing 31 December.

Short answers
I filed 2023 in January 2027. Is the refund gone?+
If the return was not filed by 31 December 2026, CRA generally will not pay the 2023 refund. Send the return anyway if you have a reason to complete the chain. Do not expect a cheque.
Does the three-year rule apply to the GST/HST credit?+
The credit depends on a filed return and on CRA’s own payment rules for that credit. A missed return stops the credit. It is not the same test as the income-tax refund limit, so look at each one.
